Terms of Service

These Terms govern your use of Marta, a service operated by SteelKiwi Inc., 160 Greentree Drive, Suite 101, Dover, DE 19904, USA (“Marta”, “we”, “us”, “our”).

By placing an order or creating an account you agree to these Terms. If you do not agree, do not use the service.

1. What Marta is

Marta calls landlords and estate agents on your behalf, in Spanish, about listings you are interested in — to rent or to buy. For each listing we attempt to:

  • confirm the property is still available;
  • ask the questions you need answered (requirements, deposit, community charges, pets, and similar);
  • present you as a prospective tenant or buyer, using the information you have given us;
  • arrange a viewing and place it in your calendar;
  • where a viewing is agreed and the landlord or agent consents, send a written confirmation of the appointment by WhatsApp — to you, and to them — including the details each side needs to reach the other;
  • report the outcome back to you.

Calls are made by an AI voice assistant, supported by human operators. On every plan, whatever the assistant cannot finish on its own — an agent who will not deal with an assistant, changed terms, a request for documents — goes to a person on our team, and you see the state of it on your dashboard. Concierge adds a named manager who runs the search with you. The assistant discloses at the start of every call that it is an AI assistant acting for a named prospective tenant or buyer.

Renting and buying are separate searches, with separate profiles and separate plans: what you buy for one says nothing about the other.

2. What Marta is not

  • We are not a real estate agency, broker or intermediary. We do not list properties, do not represent landlords or sellers, do not negotiate or arrange tenancy or purchase agreements, and do not receive any commission or payment from landlords, sellers or agencies. We act solely on your instructions, as your agent.
  • We are not a party to any tenancy or sale. Any agreement you enter into is between you and the landlord, seller or agency.
  • We do not verify listings, landlords or agencies. We report what we are told. We cannot guarantee that a listing is genuine, that the described property exists as advertised, or that a landlord will honour a booked appointment.
  • We do not provide legal, immigration, tax or financial advice.

3. Eligibility and your authorisation

By using Marta you confirm that:

  • you are at least 18 years old and legally able to enter into a contract;
  • you are genuinely seeking to rent or buy a property and will act in good faith towards the people we contact;
  • the information you give us is accurate and is yours to give.

You authorise us to act on your behalf for the limited purpose of contacting landlords and agents about listings you have selected or approved, to identify you by name as the interested tenant or buyer, and to disclose to them the information you have provided about your situation (such as employment, income, guarantor availability, pets, or move-in date) where it is relevant to securing a viewing. You may withdraw or narrow this authorisation at any time in writing; the change applies to calls not yet made.

Before your first call we ask you to confirm in the app that you understand these are real calls to real people, and to accept the commitments in Section 9. We place no calls for an account that has not given that confirmation.

You are responsible for what you ask us to say. You may not use Marta to contact a person who has not published the listing concerned, to contact anyone for a purpose unrelated to renting or buying a property, or to harass, mislead or pressure anyone.

4. Plans and pricing

You pay for Results, not for time. A listing becomes a Result when we reached a human and came back with a definite answer: a viewing booked, a slot at an open house, the property no longer available, your profile turned down, or terms that no longer match the advert. A listing where nobody ever answers, where the number turns out to be dead, or where the advert cannot be read costs you nothing. Where a call ends by being sent to another channel — WhatsApp, email, a form on the portal — or needs a person on our team, the listing is charged once our team closes it with an answer.

Plans are bought per search: renting and buying are counted separately. Before any purchase, each search runs on a free trial of 3 Results, no card required. Extra Results can be added at any time as top-up packs (+5 for €15, +10 for €25, +20 for €45, +50 for €89, +100 for €149). Moving up from a plan you have already paid for costs the difference, not the full price.

Prices are in euros and include applicable taxes: the amount shown is the amount charged. We may change prices; a change never affects an order already paid for.

Beyond 100 Results. If your search needs more — for example, an agency or a relocation team — write to support@callmarta.com and we will agree custom terms in writing before you commit.

Coverage. Marta calls listings anywhere in Spain. You add them from Idealista and Fotocasa, one at a time, as a file, or by sending the link to our WhatsApp assistant; on Concierge our team can also add listings from elsewhere on your behalf.

5. No subscriptions, no expiry

Plans are one-time purchases, not subscriptions. Nothing renews and there is nothing to cancel. Results do not expire: they stay on your account until they are used, however long your search takes. If you find a home before you have used them, they simply stay unused.

6. Right of withdrawal (consumers in the EU / EEA)

If you are a consumer resident in the EU or EEA, you have the right to withdraw from this contract within 14 days without giving a reason.

Because our service is time-critical, when you place an order you will be asked to expressly request that we begin immediately. If you make that request:

  • you may still withdraw within 14 days, but you must pay for the part of the service already performed, in proportion to the Results already delivered;
  • once the service has been fully performed — once every Result you paid for has been delivered — the right of withdrawal is lost.

To withdraw, email support@callmarta.com with a clear statement to that effect. We refund within 14 days of being informed, using the same payment method you used.

This section does not limit the guarantee in Section 7 or your statutory rights.

7. Our guarantee — no Results, no charge

On Focus and Full Hunt, if you do not have a single Result by the end of the next business day after your payment, email us and we will refund your payment in full. You keep every recording, transcript and status from the calls we made in the meantime. There is no deadline for making the claim.

We also aim to deliver your first report within 24 hours of receiving your listings and the information we need from you to start. A report tells you, for each listing, whether we reached the landlord or agent, what they said, and whether a viewing was arranged or why it was not. If we miss that window and you would rather not wait, the same refund applies.

To be clear about what the guarantee covers: it covers our side of the work — the calls and the report. It does not guarantee that a viewing will be arranged, or that a landlord will answer the phone, respond, or accept you — those depend on people we do not control. Where a landlord’s requirements exclude you, telling you that quickly is part of what you are paying for, and it counts as a Result.

The guarantee does not apply where the delay is caused by information you have not given us, listings that are unusable (expired, duplicated, or without a contactable number), or a request made outside a plan’s scope. Concierge is scoped with you individually and is covered by Section 8 instead.

8. Refunds outside the guarantee

Beyond Section 6 and Section 7, we handle refund requests case by case. Where the service failed on our side — calls not made, a report not delivered, an appointment booked into your calendar that we never actually arranged — we refund. Where the service was delivered and the market simply did not go your way, we do not.

9. Your responsibilities

Every call we place reaches a real person, and every viewing we book is a real appointment made in your name. Before your first call we ask you to confirm, in the app, that you understand this and accept the commitments below. They are the substance of that confirmation.

  • Add only listings you actually want to view. A listing you send us is a request to occupy someone’s time on your behalf.
  • Attend the viewings we arrange, or cancel in time. If you cannot make one, tell us or the agency in advance — a note on your dashboard is enough.
  • Stay reachable on the phone number and email address in your profile, so that we and the agency can reach you about an appointment.
  • Give us accurate, current information, and update it if it changes.
  • Check appointment details before you attend. We report what we were told; the landlord may change or cancel.
  • Deal with landlords and agents honestly and courteously.

Missed viewings and unresponsiveness are not a private matter between you and us: they damage our standing with the agencies we call for every other customer. Where they recur we may pause work on your account, and we may suspend or terminate it under Section 15.

10. Calls and recording

Calls made for you may be recorded and transcribed so we can report accurately and resolve disputes. Recordings and transcripts are handled as described in our Privacy Policy. You may not publish, broadcast or distribute a recording we provide to you without our written consent, and you are responsible for complying with the law if you do.

11. AI limitations

The assistant may misunderstand, mishear or misreport a conversation, particularly on poor lines, in strong regional accents, or where a call goes somewhere unexpected. We work to reduce this and human operators review problematic calls, but you should treat a report as a good-faith account of a phone call, not as a verified record. Confirm anything that matters — price, address, availability, requirements — directly with the landlord before you commit to anything.

12. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. Calls are placed during Spanish business hours and we depend on third parties — telephony carriers, listing portals, calendar providers — whose failures or restrictions may interrupt the service. Where an interruption on our side prevents us from delivering what you paid for, Sections 7 and 8 apply.

13. Intellectual property

The website, the assistant, our scripts, prompts and reports are ours. You may use reports for your own property search. You may not copy, resell, or use the service or its output to build or train a competing product, or scrape our website.

14. Liability

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

Subject to that, and to the maximum extent permitted by law:

  • our total liability arising out of or in connection with the service is limited to the amount you paid us in the three months before the event giving rise to the claim;
  • we are not liable for indirect or consequential loss, or for a property you did not get, a viewing that was cancelled, a tenancy or purchase that fell through, accommodation costs incurred while searching, relocation or visa consequences, or anything a landlord or agent told us that turned out to be untrue.

15. Suspension and termination

We may suspend or terminate your access if you breach these Terms, use the service unlawfully, or use it in a way that damages our relationships with landlords and agencies.

That last one includes the commitments in Section 9: repeatedly failing to attend viewings we have arranged, or going unreachable while an agency is trying to reach you, may lead to your account being suspended. We will tell you why and give you a chance to put it right before we suspend, unless the conduct is deliberate or leaves us no time to. A suspension pauses new calls; it does not take away work already delivered.

Where we terminate without cause, we refund the unused portion of what you have paid. Where we terminate because of conduct described above, results already delivered are not refundable. You may stop using the service at any time.

16. Changes to these Terms

We may update these Terms. The current version is always at https://callmarta.com/terms/. For material changes affecting an active plan we will give at least 30 days’ notice by email. Changes never apply retroactively to an order already placed.

17. Governing law and disputes

These Terms are governed by the laws of the State of California, and the courts of San Mateo County, California have jurisdiction.

If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of that country.

We would much rather sort a problem out directly. Write to support@callmarta.com and we will respond within five working days.

18. Miscellaneous

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the plan description you purchased, are the whole agreement between us. You may not transfer your rights under these Terms; we may transfer ours as part of a business transfer, without reducing your rights.
